Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ADSBTAK service operated by GoTAK LLC ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

ADSBTAK provides real-time ADS-B aircraft tracking data for integration with Team Awareness Kit (TAK) systems. The Service includes:

  • REST API access for aircraft data queries
  • Direct TAK Server integration for CoT streaming
  • ATAK plugin for mobile device integration
  • Web dashboard for account and connection management

3. Account Terms

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account and API keys.
  • You must notify us immediately of any unauthorized use of your account.
  • You may not share your account credentials or API keys with unauthorized parties.
  • One person or organization may not maintain more than one free account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell, redistribute, or sublicense the Service without our written consent
  • Use the Service to track aircraft for purposes that violate privacy laws
  • Exceed your plan's rate limits or quotas through circumvention
  • Use automated means to create accounts or abuse free trial offerings

5. API Usage

API access is subject to the rate limits and quotas of your subscription plan. You agree to:

  • Use API keys only for their intended purpose
  • Not share API keys publicly or embed them in client-side code
  • Implement reasonable caching to minimize redundant API calls
  • Handle API errors gracefully without excessive retry attempts

6. Payment and Billing

  • Paid plans are billed in advance on a monthly or annual basis.
  • All fees are non-refundable except as required by law or as stated in these Terms.
  • We may change pricing with 30 days notice. Existing subscriptions remain at their current rate until renewal.
  • You are responsible for all applicable taxes.
  • Failed payments may result in suspension of service.

7. Free Trials

We may offer free trials for paid plans. Free trials:

  • Require valid payment information to start
  • Automatically convert to paid subscriptions unless cancelled
  • Are limited to one per customer
  • May be terminated if we detect abuse

8. Cancellation and Termination

  • You may cancel your subscription at any time through your account dashboard.
  • Cancellation takes effect at the end of the current billing period.
  • We may suspend or terminate your account for violation of these Terms.
  • Upon termination, your right to use the Service ceases immediately.
  • We may retain certain data as required by law or for legitimate business purposes.

9. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy. You acknowledge that:

  • ADS-B data is sourced from publicly available radio transmissions
  • We do not guarantee the accuracy or completeness of aircraft data
  • Some aircraft may be excluded from results due to privacy programs (LADD, PIA)

10. Intellectual Property

The Service and its original content, features, and functionality are owned by GoTAK LLC and are protected by international copyright, trademark, and other intellectual property laws. You may not use our trademarks without prior written consent.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOTAK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless GoTAK LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website or by email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
